Welcome to Formshop (the "Site"), operated by Formshop ("we," "us," or "our"). The Site is an e-commerce platform offering design objects, wall art, apparel, books, digital prints, and furniture (the "Products").
By accessing, browsing, registering, or making a purchase on the Site, you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree with any part of these Terms, please do not use the Site.
1. Eligibility
To use the Site and purchase Products, you must be at least 18 years old, possess legal capacity, and hold a valid payment method accepted by our system (such as a major credit card or approved payment gateway account).
We reserve the right to restrict access, suspend accounts, or cancel orders if false information is provided or if these Terms are violated.
2. Orders and Purchases
Orders are placed by adding items to your cart, submitting shipping and billing details, and completing payment at checkout.
Upon placing an order, you will receive an order confirmation email. Because our items are often produced or curated in limited quantities, order fulfillment is subject to product availability in stock and successful payment authorization.
If an ordered item is out of stock, we will contact you to offer a replacement or issue a full refund.
3. Pricing, Payments, and Taxes
All prices displayed on the Site are listed in New Israeli Shekels (ILS) and include Israeli VAT where applicable, unless explicitly stated otherwise.
Prices do not include shipping costs, which are calculated and displayed separately during checkout based on delivery location and item specifications.
We reserve the right to modify prices and shipping rates at any time without prior notice. The price charged will be the price displayed at the time of order confirmation.
4. Shipping and Delivery
Products will be delivered to the shipping address provided during checkout via external courier services, or made available for local pickup at our store depending on your selection.
Delivery timeframes provided on the Site are estimates. While we work to ensure timely delivery, we are not responsible for delays caused by courier operations, customs clearances, extreme weather, security events, or force majeure.
For local pickup at our physical store (Simtat Aharon Chelouche 5, Tel Aviv-Yafo), orders will be available after you receive an explicit email or message stating your order is ready for collection.
5. Cancellations and Returns (Israeli Consumer Protection Law)
Right of Cancellation: Under the Israeli Consumer Protection Law, 5741-1981, customers are entitled to cancel a distance transaction within 14 days of receiving the Product or the summary transaction document, whichever is later.
Cancellation Notice: To cancel an order, you must notify us in writing via email to hello@formshop.co, via Phone/WhatsApp at +972 54-492-9933, or by mail to Simtat Aharon Chelouche 5, Tel Aviv-Yafo, Israel. Your request must state your full name and order number.
Cancellation Fee: In cases of cancellation for personal preference (not due to a defect or mismatch), a statutory cancellation fee of 5% of the transaction value or 100 ILS (whichever is lower) may be deducted. Return shipping costs are the customer's responsibility.
Product Condition: Returned items must be unused, undamaged, and in their original packaging, accompanied by the purchase invoice.
Defective or Damaged Goods: If an order is canceled due to a defect, damage, or discrepancy from the description, no cancellation fee will apply, and we will arrange return pickup or a full refund at your choice.
Exemptions: Statutory cancellation rights do not apply to custom-made or personalized items, perishable goods, or unsealed downloadable digital files.
Extended Cancellation Period: Customers who are senior citizens (over 65), persons with disabilities, or new immigrants are entitled to cancel a transaction within 4 months of purchase, provided the transaction involved communication between the parties.
6. Limitation of Liability
We make every effort to display product colors, textures, and details accurately. However, actual colors may vary slightly depending on display screen settings.
To the maximum extent permitted by law, Formshop shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the Site or products purchased, beyond the monetary value of the ordered Product.
7. Intellectual Property
All intellectual property on the Site—including branding, logo, text, graphics, product photography, website design, and software code—belongs exclusively to Formshop or its licensors.
No content from the Site may be copied, reproduced, distributed, or commercially used without our explicit prior written consent.
8. Governing Law and Jurisdiction
These Terms, the use of the Site, and any purchases made shall be governed exclusively by the laws of the State of Israel.
Any legal dispute arising in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts in Tel Aviv-Yafo, Israel.
