Welcome to Formshop (the "Site"). The Site is operated by Dean As (Licensed Dealer #312118557 (the "Management" or "Company"). Use of the Site and the purchase of products are subject to the terms and conditions detailed below.
1. General
1.1. By performing any action on the Site, the user declares that they have read the Terms & Conditions and shall have no claim or demand against the Site or its owners, other than claims related to a breach of the Site's obligations under these terms. 1.2. The Site Management reserves the right to update these Terms & Conditions from time to time without prior notice.
2. Products and Orders
2.1. The Site offers wall art, objects, and design items for sale. 2.2. Visual Representation: Product images are for illustrative purposes only. Slight color variations may occur between the colors displayed on your screen and the physical product due to differences in screen resolution and calibration. 2.3. Prices on the Site include VAT as required by law, unless otherwise stated.
3. Cancellation and Returns Policy (In accordance with Israeli Consumer Protection Law)
3.1. Right to Cancel: A customer is entitled to cancel a transaction within 14 days of receiving the product. 3.2. Cancellation Fee: For cancellations not due to a defect, a fee of 5% of the transaction price or 100 NIS (whichever is lower) will be charged. The cost of return shipping shall be borne by the customer. 3.3. Exclusions (Crucial): According to Section 14C(d) of the Israeli Consumer Protection Law, transactions for "goods manufactured specifically for the consumer" cannot be canceled. This means that art prints made to order (specific size, material, or custom framing) are non-returnable and non-exchangeable unless they are defective. 3.4. Products must be returned in their original packaging and must not have been used.
4. Shipping and Delivery
4.1. Delivery will be made to the address provided at the time of order or via local pickup at 5 Aharon Chelouche Lane, Tel Aviv (by prior appointment). 4.2. The Site Management is not responsible for delivery delays resulting from "Force Majeure," strikes, holidays, or delays caused by the shipping company. 4.3. Shipping Damages: The customer must inspect the product immediately upon receipt. In case of damage caused during transit, the customer must report it to Site Management within 24 hours of delivery, accompanied by a photograph of the damage.
5. Intellectual Property
5.1. All copyrights in the artworks, designs, images, and texts appearing on the Site belong exclusively to Formshop and Dean As. 5.2. It is strictly prohibited to copy, distribute, publicly display, or make any commercial use of the Site’s content without express written permission.
6. Privacy Policy
6.1. Data Collection: We collect personal details (name, phone, email, address) solely for order fulfillment and customer service. 6.2. Security: The Site is secured with SSL encryption. Credit card details are not stored on our servers; they are processed directly by an authorized and secure PCI-DSS payment gateway. 6.3. Cookies: The Site uses cookies to enhance user experience. You may disable them via your browser settings. 6.4. Marketing: Subscribing to our newsletter constitutes consent to receive marketing materials. You may unsubscribe at any time using the "Unsubscribe" button at the bottom of our emails.
7. Jurisdiction
7.1. These Terms & Conditions are governed solely by the laws of the State of Israel. Exclusive jurisdiction shall lie with the competent courts in the District of Tel Aviv.
